Abstract

The alarming prevalence of sexual violence in Indonesia in recent years has prompted the government to prioritize the creation of a draft law on the Elimination of Sexual Violence, included in the National Legislation Program Priority 2021. The imminent ratification of this draft law is anticipated to provide comprehensive regulation on sexual violence, addressing various forms of this pervasive issue. This research aims to analyze the evolution of sexual violence data in Indonesia and assess the urgency of ratifying the draft law in light of the persistently high rates of sexual violence. Employing a normative legal research method utilizing statutory, conceptual, and case approaches, the research identifies a continued increase in sexual violence crimes, encompassing both physical and non-physical forms. Several factors contribute to the prevalence of sexual violence, including the inadequacy of institutional readiness and human resources to effectively address these crimes. Moreover, existing regulations have failed to comprehensively address the diverse manifestations of sexual violence, leaving gaps in prevention, response, and victim recovery efforts. Thus, the enactment of the Sexual Violence Law (UU TPKS) emerges as a pressing social imperative to mitigate and combat sexual violence effectively.
